Traumatic Brain Injury Accidents

Tuesday, September 27th, 2011

One of the most serious injuries you can sustain in a traffic accident is a traumatic brain injury. Traffic accidents are also one of the main causes of such injuries, accounting for roughly 40% of the 1.7 million people who sustain such an injury, the Centers for Disease Control and Prevention reports. Sadly, more than 50,000 motorists suffering from traumatic brain injuries also died each year.

When a person is in a car accident their head is likely to hit the steering wheel or windshield with incredible force unless there are functioning airbags and proper restraints in place to prevent it. However, even with an airbag to slow you down, the brain can be bruised or end up bleeding by being shaken inside the skull. Indeed, head injuries can range from minor concussions, where symptoms can include headaches and confusion, to the most serious skull fractures that involve seizures and possibly even resulting in a coma.

Although many injuries are clear to the victim on the day of the accident, traumatic brain injuries are not necessarily known by the victim until later. Additionally, unlike other injuries that may eventually heal, injuries to the brain may scar a victim for life. When this happens it’s likely your life will never be the same. You or your family member may never work again or enjoy life as they once enjoyed it. Many people are no longer able to return to their careers because recovery is often never fully achieved. Rehabilitation therapy is costly and may take may months or even years.

Hiring an experienced personal injury lawyer is the first step toward recovery. The motorist who hit your vehicle and caused your injuries can be held accountable for their actions and you may be entitled to compensatory damages, or if they were reckless, punitive damages. Despite laws prohibiting motorists from talking on cell phones, drinking or other distracting activities, drivers who cause accidents need to be held accountable for their actions.

Medical care can be expensive so you need to be assessed by medical professionals to determine the full extent of your injuries. Whether you need short-term medical attention or long-term assistance for permanent disability, you want to make sure you are compensated by those who are responsible.

It’s important that you seek help immediately from an attorney who is a specialist in auto accident claims and who knows how to get your family member the help they need.

Latest Roadway News….

Tuesday, September 27th, 2011

The following news stories detail the latest roadway incidents happening across the California highways. As always, we urge everyone to exercise extreme caution and concern for others while operating a motor vehicle. Always look out for pedestrians, cyclists and other reckless drivers. The smallest extra attention to detail could save a life.

One Person Killed, Two Injured in Crash: CHP officers in Monterey County responded to a crash early Sunday morning that left one motorist dead and two others critically wounded. The incident occurred near McFadden Road in Monterey and involved a head-on collision of three vehicles. Witnesses reported seeing one driver driving erratically, speeding and passing vehicles on the right shoulder. The road was completely closed for two hours following the crash to allow for an investigation.

Cyclist Killed in Solano County: A bicyclist was killed Sunday after his bicycle was rear-ended by a vehicle driven by a 21-year old male. The driver of the vehicle stated that he could not get around the bicyclist to pass him but witnesses report seeing no impediment preventing the driver from avoiding the collision. Alcohol, drugs and vehicular mechanical issues are not considered a factor in the incident. At this time, no charges have been filed against the driver.

Man Killed Riding Dirt Bike: A teenaged-male was killed late last week in a dirt bike accident near Bakersfield, California. The man was operating the bike on an enclosed course when he attempted to perform a jump. He lost control of the bike and collided with a steep dirt embankment close by. The victim suffered major injuries on the scene and later died at Mercy Hospital.

Elderly Driver Escapes Collision with Train: An 85-year old driver escaped major injuries after his pickup truck collided with an Amtrack train Sunday morning. CHP responded to the report of a crash on the tracks near Madera to find the driver’s 2010 pickup truck had collided with an oncoming train. Despite warnings and the lowering of the safety “arms” preventing drivers from crossing the tracks, the driver seemingly proceeded into the intersection anyway. The man was injured but survived after being nearly run over by the massive oncoming train.

Motorcyclists Need to Stay Alert

Monday, September 26th, 2011

Driving a motorcycle in California is dangerous.  You are out there fighting traffic on two wheels instead of four.  A leather jacket, sturdy riding boots and a helmet may be all that you have as protection from the road and other drivers. Your helmet is likely to save your life. There’s no doubt that riding is an adventure, but hopefully the ride doesn’t end in tragedy.

Statistics show the risk of driving motorcycles you are 35 times more likely to wind up in an accident than driving any other vehicle on the road. In fact, motorcycle drivers in California represent 2.1% of all vehicles registered, but their drivers and passengers account for nearly 9.5% of all traffic deaths in the state.  It’s for these reasons you need to protect yourself and practice safe driving. Make sure you are not invisible to other drivers by making safe passes and avoid driving between vehicles.

Injuries are also more likely to be serious if you are in a motorcycle accident than if you are in a car accident so you will need to have the best representation when you pursue a lawsuit. While broken bones, cuts and bruises may eventually heal, more serious injuries to the head may need long-term medical treatment. Sometimes the injuries may result in permanent disability.

Tragically, you may have lost a loved one in a motorcycle crash that was not their fault. There were 4,281fatalities resulting from motorcycle accidents in the United States in 2009, according to the latest research reported by the Insurance Institute of Highway Safety.  Indeed, a  motorcycle driver is up against some pretty heavy hitters on the road. Whether it’s a 3,000-pound passenger car, a massive commercial truck or pretty much any vehicle on the road, the biker is at a tremendous disadvantage.

Additionally, more than half, some 55% of accidents involved multiple vehicles in the accident compared to 45% involving single vehicle accidents. Motorcyclists are quite often hit by one vehicle which in turn propels them into the path of yet another vehicle. Finally, nearly half of the accidents involving motorcycles, or 1,806 of the drivers and passengers, were not wearing a helmet. While it is the law to wear a helmet here in California, some provide better protection than others and some cyclists make the mistake of not securing the strap when they put it on their head. While protecting yourself on the road is important it cannot prevent an accident from happening, nor can it ensure you  will come out of it unscathed.

Finding the right attorney who understands your case is as important as wearing the right protection when you ride on the streets. It’s important that you focus on getting the medical attention you may need and that your attorney focuses on your case.

Latest News Across California’s Highways….

Tuesday, September 20th, 2011

It is important to understand the need for safety and alertness when operating a vehicle, bicycling, walking or jogging around California’s roadways. Evils like distracted driving, driving while intoxicated or using a handheld device behind the wheel can lead to devastating consequences and painful personal injuries. The following stories detail California Highway Patrol’s most recent roadway incidents.

Fatal Motorcycle Crash: A 36-year old Tara Hills man died over the weekend from injuries sustained in a single-vehicle accident. The victim’s passenger, a 33-year old male, is listed in critical condition today after being flown from the bike and colliding with a parked SUV. Oakland-area CHP officers responded to the incident and it is unclear whether drugs or alcohol played a role in the crash. Details seem to suggest that the bike came in contact with a raised curb and was spiraled out of control.

Oil Spill: A campground located in San Bernadino County was evacuated and Highway 38 has been entirely closed due to an overturned tanker. Very fortunately, no one was injured in the incident. However, the tanker has leaked at least 1,000 gallons of gasoline onto the roadway after it overturned around 10:20pm on Monday evening. CHP warns motorists that Highway 38 may not reopen until at least Wednesday.

Pedestrian Killed: An unidentified man was struck and killed Monday night while walking in the Fresno area. The incident occurred around 9pm and the driver of the vehicle responsible for the incident claimed she could not see the man in the street as he was dressed in dark clothing. The victim was pronounced deceased at the scene and CHP does not suspect that drugs or alcohol were a factor in the accident.

CHP Releases Seatbelt Rates: California has the highest seatbelt compliance rate in the United States according to CHP’s recently-released reports. In statistics revealed Monday, CHP has found that 96% of Californians buckle up while driving. These reports coincide with CHP’s participation in National Child Passenger Safety Week which is designated for this week, September 18-24, 2011.

Fatal Collision: The driver of a late-model Toyota pickup truck was killed this morning after failing to come to a stop at a stop sign. CHP reports the fatality occurred in the Fresno area at an intersection in a semi-rural area. The driver of the other vehicle involved in the crash was unable to stop in time before colliding with the Toyota. The driver of that vehicle survived the crash. CHP does not suspect that alcohol, drugs or driver fatigue were involved in this collision.

Motorcyclist Critically Injured Friday Evening

Saturday, September 10th, 2011

This morning brings news of a near-fatal motorcycle crash on Highway 101 as the rider clings to life in an area hospital. We have warned of the dangers of motorcycles in the past and just wish to not only reiterate our sincerest hope that this crash victim will make a full recovery but that others will take extra precautions when riding to avoid further accidents and injuries. Motorcycles are a great recreation for many around California and can provide a much-needed escape from the congestion of Californian’s urban areas. However, these bikes also present a significant safety risk and all necessary precautions should be followed- including participation in a state-sanctioned road safety course.

This morning’s report stems from an accident occurring on Highway 101 in Palo Alto around 7:30pm, Friday evening. California Highway Patrol responded to the scene and found the victim lying on the ground with no pulse or breathing activity. The motorist was immediately rushed to Stanford Medical Center where his current condition is unknown at this time. The coroner has not been notified of the accident as of late Friday evening.

As details and witness statements emerge, it is possible that one of the three vehicles involved in the accident may have been driving recklessly- causing the chain of events which resulted in the severe injuries to the cyclist. Officers conducted a 90-minute investigation and closed the left lane of southbound 101.

If you or a loved one enjoy riding motorcycles- perhaps as a hobby or a primary mode of transportation- we urge you to always practice extreme safety and prudence when operating your bike. Never exceed posted speed limits or weave in and out of traffic. As always, be sure to wear a helmet even if just going up the street. Helmets have saved countless lives in serious accidents that would have otherwise proven fatal for the rider.

Safety of California’s motorists is the preeminent concern of law enforcement officials including the state’s California Highway Patrol- a group tasked with ensuring highways and interstates are kept safe and free from unnecessary risk. It is important to us, as well, that all California drivers exercise caution and do not drive distracted or intoxicated- two acts which endanger the lives of everyone with a driver’s license. We like to keep readers keen on what is happening around the state in hopes that it will alert others to the potential safety risks and the possible consequences of distracted driving.

Crash Blocks Highway 101: Los Angeles drivers were stuck behind a massive crash on Highway 101 this morning after three vehicles collided with one another around 6am. The incident took place near Glendale Boulevard. Officials report that one person was seriously injured and taken to the hospital. Today marks the first day of school for those in the Los Angeles Unified School District and this morning’s traffic tie-up likely affected many children making it to class on time. Clean-up crews expected to have the right southbound lane to re-open around 7:30am.

- Woman Dies in Fatal DUI Crash: A Merced County woman was killed Sunday evening after crashing her 2003 Ford Focus. California Highway Patrol believes the woman was under the influence of alcohol at the time of the crash. Witnesses reported seeing the vehicle veer off the road and then over-compensate for the mistake. She then veered into the other lane and struck a concrete barrier and wooden fence. The victim was ejected from the vehicle.

Motorcycle Crash Claims a Life: A 58-year old woman was killed in a motorcycle accident on Sunday night. The crash is thought to have been caused during the melee involving a three-county high-speed chase. The woman was killed after her husband, the driver, lost control of the bike after hitting  median strip. Witnesses report seeing the driver look backwards as another man was evading police over a string a burglaries. As the cyclist turned back around, he realized the vehicle in front of him had stopped. He slammed into the median to avoid hitting the vehicle. His wife was ejected from the passenger seat and sustained fatal head injuries.

Latest on California’s Roadways…..

Thursday, August 25th, 2011

We always like to keep you updated on the latest from the CHP as you navigate around California- not only so you can avoid monstrous traffic delays but also as a reminder of the potential for tragedy as so many of California’s drivers are driving distracted and recklessly. We hope that none of you are ever involved in an accident or incident and urge each driver to exercise caution and prudence around other drivers, cyclists and pedestrians.

Still developing: A car and a big rig collided with one another on highway 805 Thursday morning. CHP is working tirelessly to free the car as it is trapped under the truck. The incident occurred near Sweetwater Road and crews are in the midst of freeing a silver Toyota Avalon from the underside of the truck. No news has been reported as to the condition of the drivers. Two southbound lanes are closed around the scene of the crash.

A driver on Highway 99 tragically lost his life on Wednesday as the truck he was traveling in rolled over just south of Victor Road. CHP has not released the driver’s name or age but did confirm that the truck involved was a mid-sized Chevrolet that, for reasons unknown, was passing a driver using the shoulder of the roadway. The driver then lost control of his vehicle and crashed into a cement bridge abutment- landing on the roof.

In a bizarre twist, CHP is being named as responsible for striking a motorcyclist in Adelanto. The female rider sustained minor injuries and is likely to file a complaint against the department for damages. Both the victim and the CHP patrolmen were traveling next to each other on southbound Interstate 15 when the patrol car ran into the left side of the motorcycle- sending the bike to the side of the road. CHP claims the patrol car was in the process of trying to pull a big rig over when he collided with the bike. CHP did a “thorough investigation” and the officer returned to work the following day.
