First Steps To Take After a Fender Bender

Saturday, October 29th, 2011

Most drivers do not regard fender benders to be accidents of a much worthy note. However if you are involved in a fender bender, it is always advisable to make sure that you get some relevant information about the accident in the event that you have to make an insurance claim or the other party makes an insurance claim against you.

The first thing to do is to check the extent of the damage. It may not be substantial on the exterior of the vehicle but there may be internal damage that is caused that will only become apparent later. Therefore it is important that you collect some key information before driving off from the scene of the accident. This information includes the names, addresses and contact details of the other parties involved in the accident. If you can, also take note of the vehicle make and model as well as the license plate number as well.

Most drivers will also be able to provide you with information about the insurance company that they are using, and ideally you should also get information about the Vehicle Identification Number (VIN). The VIN is usually found at the dashboard, at the driver’s side of the vehicle. If it is not visible there, it can also be found on the doorpost, on the insurance policy or card or on the ownership documents. The VIN is different from the license plate number and comprises 17 characters.

Of all the information that you obtain, the VIN number is the most critical as through this, it will be possible to track down the vehicle details. This is because almost all insurance companies use the VIN as the means to track a vehicle rather than the registration number as the former cannot be altered whereas the latter can.

Once you have done this, make an appointment with your mechanic to determine the extent of the damage. If it is minor, then you have to decide whether you are prepared to pay for this yourself, or if the other party caused the accident you can contact him and negotiate for him to pay for the damages. If however the damage to your vehicle is more extensive, then you will want to consider making an insurance claim. In the event that you are uncertain about how to proceed on this, it may be useful to get the advice of a car accident lawyer to determine what needs to be done and how.

It is also useful that you contact your own insurance agent as soon as possible after the accident. If the damage is extensive then it becomes important that you get copies of any police report that have been filed about the accident, as this documentation is important for the purposes of making a claim, either to your own insurers or the insurance company that the other party uses. You will find that in many instances, while it may appear at first instance to be a simple fender bender, there can be more extensive damage to the car that will require support and assistance not only from your insurance agent but also your car accident lawyer.

Pedestrian Killed by Hit and Run Driver, Car Accident Lawyer Says

Friday, October 28th, 2011

LOS ANGELES, Calif. –  Police are searching for a suspected hit-and-run driver who struck and killed a woman last night near the intersection of Vermont Avenue at Ashbridge Lane. Witnesses described the hit-and-run driver’s car as a green or silver passenger car with four doors. The vehicle also had a flat tire and damage to its front end where it struck the woman.

Statistics show that hit-and-run drivers were blamed in more than 9% of all injury and fatal traffic collisions here in California, according to the Department of Motor Vehicles.

Nationally, roughly 11% of all traffic collisions were attributed to hit-and-run drivers, according to the AAA Foundation for Traffic Safety. Drivers fleeing the scene of a hit-and-run accident involving a pedestrian have been on the rise as much as 20%, the latest national statistics compiled between 2000 and 2005 show.

Pedestrians and bicycle riders are vulnerable to being hit by motorists at night when visibility decreases, but the law requires drivers who hit another person or vehicle to provide assistance to the injured person. The motorist responsible for the accident should call 911 and wait for police to arrive to report what happened. Those who flee the scene of the crime may face fines and criminal penalties such as imprisonment, car accident lawyers say.

Personal injury lawyers handle many types of car accidents including victims of hit-and-run incidents where someone may have been injured or killed. Those affected by accidents of this nature are likely to have many questions such as: How will I pay the medical bills? Will insurance cover my losses? How much does a car accident lawyer charge to handle my case?

Contact Ledger & Associates if you have any information that could lead to the arrest and conviction of this driver.

Making A Police Report When Involved In a Car Accident

Friday, October 28th, 2011

Being involved in a car accident can be a traumatic experience. This is regardless of whether the accident has caused personal injury to you or your passengers or merely resulted in property damage. What is important to remember when you are involved in a car accident is to ensure that you make a police report as soon as possible after the accident has occurred. This is because the incident will be fresh in your mind, and you will be able to grasp the details more vividly.

You will need to remember that making a police report is a critical part of resolving any matters that may subsequently arise. If the police are at the scene of the accident, and they usually will be if the accident is a serious one that has resulted in loss of life or personal injury, then ensure that at the very least the police officer has been given your particulars even if he is unable to take your report on the spot. This way the police officer can contact you later to get the details about the accident from you.

If there are no police present at the accident, which may be the case if the accident is a minor one, you will nonetheless have to lodge a police report. This written record of your statement, and the statement of the other parties involved in the accident, as well as witness statements can then be used in the event of a legal suit or the filing of an insurance claim. When you have lodged your police report, always ensure that you request a copy of the report to take with you when you leave. If for any reason the officer is unable to provide you with a copy of the report, ensure that you at least have information about the officer’s name as well as the reference number for the report and the police station it will be filed at.

Once you have filed a report, and there is a possibility that you will need to make an insurance claim, try to ensure that you seek legal advice from a car accident attorney as soon as possible. You will find that regardless of whether you are the victim, or the cause of the accident, the car accident attorney will be best positioned to advise you about what your rights are. Take a copy of the police report with you as well as any and all insurance documents and car registration documents when you meet the car accident attorney.

The car accident attorney will then be able to evaluate the details of what happened based on your police report as well as your verbal account of what happened at the accident scene. The car accident attorney can then provide you with guidance about your rights and the next steps that you will have to take. This may involve filing a claim with your insurers or the insurers of the person who caused the accident.

Dealing With Insurance Matters After a Car Accident

Thursday, October 27th, 2011

Being involved in a car accident will usually mean that there has been damage to your vehicle and the possibility of personal injury. Where there is no personal injury and merely damage to the vehicles involved in the car accident, sometimes, the parties opt to deal directly with each other and make any settlements on their own. As a general rule, this is not a good idea as there are many inherent risks in handling an accident claim matter on your own.

You will find that the best thing to do is to refer the matter in the first instance, to the police in order to ensure that all the relevant reports are made and that the investigations that are required to be completed by the police are concluded. Based on that, it is then advisable to contact a car accident lawyer in order to set up a consultation to discuss the matters arising from the accident. The car accident lawyer will specifically be able to advise you about your rights as a victim or perpetrator in the accident, as well as provide you with advice about how to deal with the insurance company in order to make the necessary claims.

You will have to bear in mind that you should avoid delaying this matter unnecessarily. If you do not know any personal injury lawyers, then you should look for one either with reference to friends and family who have used their services, or even by searching online. Many reputable law firms are listed online and you will be able to explore the options from the comfort of your home. Once you have narrowed down the specialist car accident attorney you would like to meet, set up an appointment and go in for a discussion.

Using a car accident lawyer to deal with the insurance company is often a good idea. There is a better chance that you will receive higher settlement claims when there is a legal professional involved as they are able to craft the claim more effectively and in line with the requirements of the insurance company. While you will have to pay legal fees and other peripheral costs as a consequence of such consultation and action on the part of the car accident lawyer, remember that you will probably be able to claim a larger sum, therefore it may well be worth it.

Going For The Medical Examination After a Car Accident

Thursday, October 27th, 2011

If you have been involved in a car accident and suspect that you may have sustained minor injuries, do not ignore this. It is always better to seek immediate medical attention. Whether it is a slight bump to the head or a sprain to your arm or any injury that you feel you can manage on your own, ideally you should still seek medical attention. Most people are willing to deal with such “minor” medical issues only after they have sorted out what they believe to be the priority – the claim and vehicle damage and other related aspects.

The reality is that if you have suffered any form of injury as a consequence of the car or vehicular accident, there is a possibility that you can make a claim for insurance to cover the cost of your medical expenses. As such, the faster you seek medical attention; the better. Any delay can result in weakening the case that you may have against the other party or the benefits that you may be entitled to from the insurance. This is particularly the case where the gap between the time of the accident and the seeking of medical attention as too long. If indeed you are unable to seek immediate medical attention, you should ensure that you have had a medical examination within 24 hours of the accident.

When visiting medical professionals, always highlight that you have just been involved in an accident. It is also useful to explain which part of your body has suffered from point of impact injuries and ask for these to be checked out. Any injury to your head, back or neck can result in long term trauma and as such, these must be highlighted to the medical professional you meet. You will also need to explain whether you have suffered any blurring of vision, nausea and other similar psychosomatic symptoms that may be indicative of other injuries.

Once you have received the medical report, it is useful to take this as well as a copy of the police report, and the details of the other parties involved and your insurance documentation to meet a personal accident attorney. This is so that you can seek legal advice in the event that any claim needs to be filed about the accident. You need not worry about the discussion of fees for your personal accident lawyer in the first instance. Treat this first meeting as a consultation in order that you can understand what your options are. Based on this, if the personal accident lawyer advises that you may have a viable claim against the insurance company or the other party involved in the accident, then you can discuss how the fees are to be paid.

Many personal injury or auto accident lawyers are prepared to work on contingency fees whereby then will only take a percentage of the winnings in the case. This is advantageous to you as it means that you do not have to pay anything upfront of the legal advice that you receive and the work the auto accident lawyer will do in preparing your case.

How To Select A Personal Injury Attorney

Tuesday, October 18th, 2011

Whether you have suffered personal injury as a consequence of a vehicular accident or due to the negligence or recklessness of any party other than yourself, chances are you will need the services of a personal injury attorney to assist you in dealing with the matter, and in determining whether to file a suit against the other party who may have caused your personal injury.

In this regard, there are several criteria that a personal injury attorney should fulfill before you make the selection. This is to ensure that to receive the best possible legal advice that you can afford and that the personal injury attorney is best placed to provide you with the relevant direction you should take the matter, if at all.

The law, like many specialized branches of industry, also has specializations of its own. In this regard, personal accident law or tort law as it is known in the industry, is regarded as a specific branch and there are many attorneys who specialize in this area. If you approach a law firm or attorney who handles most types of matters, chances are he will be able to advise you generally about the direction in which to take the case, however he may not be as familiar with the intricacies of personal accident or personal injury law as a specialist attorney in this area.

As a consequence, it is best that you evaluate firstly, whether the lawyer you are consulting is specialized in personal accident or personal injury law. This will ensure that you get the best possible advice in this direction. In your first meeting with the personal injury attorney, apart from sharing information with him about what happened to you and how the injuries arose, it is also advisable that you check his credentials.

This can be done very simply, by asking the attorney a series of questions. Amongst the questions to ask are firstly, whether he or his firm focuses specifically on personal injury matters. Secondly you will need to determine the number of cases the personal injury attorney handles each year. This will give you an idea about the amount of exposure the attorney or his aw firm may have to this area. The more current cases the better, as this means that they are also knowledgeable about the latest developments in the law in this area. Third, you will need to ask about whether he has handled specific cases like the one you are presenting to him and whether he has won such cases. He will be able to share such information with you without divulging the details of such cases and from this, you can also gauge your chances of winning the case and the amount of money you can claim.

The next question should focus on the payment of fees. Most personal injury attorneys recognize that their clients may not be able to afford to pay upfront fees. Consequently, they are usually prepared to work on a percentage of the claim, when the case succeeds. You will however have to work out the specific details with the attorney concerned in order to understand what your financial liabilities will be in this regard.

Steps to Take After an Accident Car Accident Lawyer Advice

Monday, October 17th, 2011

After an auto accident you may be disoriented, shaken, distraught and possibly injured and wondering how did this happen? The impact of an accident can be minor or devastating depending on a number of factors including speed, road conditions, where and how the vehicle is hit, whether either driver is distracted or paying attention and traffic considerations. Whatever the circumstances are you should try to remain calm and level-headed.

So what are the steps you should take immediately after a car accident? That depends on whether an accident is serious or not. If it is minor, put your hazard lights on and move the cars to the side of the road as long as it is safe. Try to remain inside your car until help arrives. If you carry cones or flares, it can be helpful to put those out behind your car to warn other drivers, but you must be careful to watch for traffic because pedestrians on the freeway can easily be struck by a car.

However, if the accident involves serious injuries, you will need to call for immediate help by dialing 911 for emergency assistance. Any delay in contacting help could have dire consequences if someone is seriously injured. Do not move an injured person if they are not in any danger.  If someone has a neck or back injury moving them could make it worse. However, if there is danger of gas exploding, fire or another threat to the person, if they cannot stay in the car because of imminent danger move them slowly and carefully to avoid further injuring them. Next, you should call the police and file a police report even if you think the accident is minor. If a police officer arrives at the scene be sure to get their name and badge number.

Never admit you are guilty after an accident because all the circumstances need to be investigated. It’s important to call a personal injury lawyer so a full investigation can be initiated to determine whether you have a case against another driver. Make sure you take down notes of what happened, names and phone numbers of the other people involved in the accident and any witnesses at the scene. You will also need the other driver’s license plate number, driver’s license number, insurance information and home address. Additionally, if there are passengers in the other vehicles get their names, telephone numbers and addresses as well.

Seek medical attention for your injuries and keep track of your visits in a journal and retain receipts for any copayments or costs involved in treating your injuries. Keep a list of names for doctors who have treated you including their address and telephone number.

So what if you are struck by a hit-and-run driver? Do all of the above and try to get a good description of the other driver. Witnesses can be especially helpful so make sure you get names of anyone who may have seen the accident. If you hit someone else you are required by law to stay at the scene of the accident until police have completed their report and released.
